You no longer have to fly to Tbilisi for it. A remote power of attorney lets you grant authority to another person online, with a notary involved.

This article explains in plain terms who can use the service, what the process requires, and where translation comes in.

What a remote power of attorney is

A power of attorney is a document by which one person grants another the right to act on their behalf — to make transactions, submit documents, or manage property.

A notarized power of attorney becomes legally binding once a notary certifies it. The Notary Chamber of Georgia describes a procedure for issuing a power of attorney online. Source.

Who can use the online notary service

Two categories are entitled to online notary services:

any citizen of Georgia;

a person who holds a Georgian residence permit.

So a foreign national can use the service too, as long as they hold a Georgian residence permit. This is especially convenient for those temporarily abroad.

What you need technically

Issuing a power of attorney from abroad requires technical preparation. The Notary Chamber lists:

a computer;

internet;

a webcam;

headphones.

Confirm the equipment and connection requirements with the notary in advance. The notarial act is certified online by a notary operating in Georgia, via electronic means of communication. Source.

Who must attend the process

According to the Notary Chamber’s page, two additional people must be present with the notary when a remote power of attorney is certified — a signer and a witness. The principal participates remotely. Source.

The signer

The signer is a person who, instead of the principal (the one granting the power of attorney) and at their request, signs the notarial act. They must attend the act. The signer may be a relative but cannot be a party to the notarial act themselves.

The witness

The witness attends in the capacity of a witness and also signs the act. They must be an adult, legally capable, and literate. The witness must not gain any direct or indirect benefit from the notarial act, and cannot be a close relative of a party or of the notary (up to the third degree in the ascending/descending line), nor an employee of a participating legal entity.

Two additional people attend with the notary: one signs in place of the principal, the second as a witness. The principal connects remotely. Source.

How the process works

The participants agree on a time for the call in advance.

At the appointed time, the person granting the power of attorney connects with the notary online.

The signer and the witness are present with the notary.

The notarial act is drawn up and certified via electronic communication.

Before the power of attorney is certified, its text is read aloud by the notary. Source: Notaries Law, Article 50(2). At this same stage the notary gives additional explanations — what each clause means and what legal consequences follow from granting the power of attorney. This ensures the principal fully understands what authority they are handing to another person.

How much a remote power of attorney costs

The fee for certifying an application or power of attorney received via direct electronic communication (including amendment and cancellation/revocation) is:

with an individual’s participation — 60 GEL;

with a legal entity’s (or sole proprietor’s) participation — 90 GEL.

The electronic register fee is an additional 5 GEL. VAT is added where applicable, if the notary is VAT-registered. You may also need to pay for document translation and certification of the translation — that is a separate fee. Source.

Translating the power of attorney — when you need it

If the power of attorney is being prepared for use abroad, or if your documents are in another language, you often need power of attorney translation and notarization of that translation.

A separate important rule: if the principal does not speak Georgian, a translator is generally involved, subject to the exceptions in the notarial instruction.
